In an interview, the head of the Department of the Federal Bailiff Service for Dagestan, the chief bailiff of the Republic of Dagestan Alik Alilov, spoke in an interview with the department. Thanks to the amendments to the article of the Criminal Code of the Russian Federation, according to which, even for a small debt, the debtor can be involved first to administrative, and with repeated violation and criminal liability, there was a large leap in this direction. So, in the past year, criminal cases against non -payers were instituted. It can also be noted that the complexity of enforcement proceedings for the recovery of alimony is associated with both objective and subjective reasons.

For example, many debtors do not have a permanent job. Often they deliberately enter a low -paying work in order to underestimate the amount of alimony, even quit from prestigious and highly paid posts. In particular, we send many non -payers to the units of the employment service. For example, over a year of such debtors there were more people. But cases are also characteristic of the republic when debtors go to work in other regions, work without concluding employment contracts, which leads to the impossibility of establishing their place of work and income, which in turn leads to the accumulation of alimony arrears.

And what are the results of the recovery of administrative fines? I can say that in the year there were 1.9 million enforcement proceedings on the recovery of administrative fines for decisions of the traffic police. As a result of the measures taken, over 1.5 billion rubles were recovered. I note that one of the effective measures in the recovery of debts remain raid measures and the arrest of property, thanks to which 54 million rubles were recovered last year, of which 21 million rubles are precisely the fines of the traffic police.

Units of vehicles were arrested. Summing up as a whole, it can be noted that in the structural divisions of the administration there were 2 million thousand bailiffs completed or terminated about one and a half million enforcement proceedings in the amount of 18 billion rubles. Millions of thousand rubles were transferred to the federal budget of the year, of which the executive fee amounted to millions of thousand rubles.

In addition, in the year there were many legislative changes in the field of social support of citizens and adjustments were made in the legal field in which the bailiffs work. This is the federal law, which allows to eliminate the erroneous identification of the debtor, and the law providing the monthly preservation of the subsistence level when applying to the income of the debtor, as well as legal acts aimed at protecting citizens participating in a special military operation.

By the way, four bailiffs from the units to ensure the established procedure for the activities of the courts and the special forces branch for several months with honor have been performed by official duties in the territories of my own. What was done in this regard last year? It is enough for citizens to contact our service. The applicant needs to indicate his personal data: surname, name, patronymic, citizenship, details of an identity document, place of residence or stay, contact phone number. But it is necessary to prescribe the details of the open bank account, in which it is necessary to maintain income monthly in the amount of the subsistence minimum, the name and address of the credit institution serving the account.

It is also necessary to submit documents that confirm the presence of monthly income and its sources. Already on the basis of the information submitted by the debtor, the bailiff will issue an appropriate decision and send it to the bank for execution. If the debtor has dependents whom he contains, it is possible to maintain the amount of the amount more than the set size on the accounts, but for this you need to go to court.

However, the right of citizens to the monthly preservation of funds in the amount of the subsistence minimum does not apply according to the executive documents containing requirements for the recovery of alimony, for compensation for harm caused, and in connection with the death of the breadwinner, as well as on compensation for damage caused by the crime.

We try to treat all categories of enforcement proceedings as priority. After all, the main goal of our work is the restoration of justice in society.
